General Terms and Conditions (GTC) and House Rules
for the rental of the apartment "Home Shanti Studio", Leipzig
Landlord: Michael Ackermann, Helmholtzstr. 12, 04107 Leipzig
Section 1. Scope and Contract Formation
- These General Terms and Conditions apply to contracts for the rental of the apartment "Home Shanti Studio", Schletterstr. 18, 04107 Leipzig, for accommodation purposes as well as all additional services provided by the landlord to the guest.
- The accommodation contract is concluded when the landlord confirms the guest's booking request in writing or by email.
- For bookings made through external booking platforms (e.g., Booking.com or Airbnb), the conditions of those platforms take precedence; these GTC apply supplementarily.
Section 2. Payment Terms and Tourist Tax
- The entire invoice amount is due immediately upon contract conclusion without deduction.
- Payment can be made via PayPal or by bank transfer. A binding booking guarantee only exists after full payment has been received.
- For short-notice bookings (less than 48 hours before arrival), immediate payment by credit card or instant bank transfer may be required.
- The accommodation price is exclusive of the legally required tourist tax of the City of Leipzig (5%). If this was not captured during the booking process, it will be charged separately.
Section 3. Arrival and Departure / Identity Verification
- Check-in is from 4:00 PM onwards, self-service via a NUKI smart lock system using a numerical code.
- The guest is required to provide the landlord with a copy or photo of a valid photo ID (identity card or passport) before check-in for identity verification and compliance with legal registration requirements.
- Check-out must be completed by 10:00 AM at the latest. At this time, the access code will automatically expire.
Section 4. Key Handling
- A physical key is kept in the apartment for security purposes. This is intended exclusively for emergencies or internal use and must be left in the apartment upon departure.
- Should the guest accidentally pack the key, it must be returned immediately at the guest's own expense as an insured package to the landlord.
- In case of key loss, the guest is liable for the costs of replacing the lock cylinder and any necessary changes to the building entrance door lock system. A flat fee of 250.00 EUR will be charged for this, unless the guest can demonstrate that a lower amount of damage was incurred.
Section 5. Cancellation by the Guest
- Cancellations must be made in text form (email or written notice).
- Cancellation is free of charge up to 7 days before arrival.
- For cancellations less than 7 days before arrival or in case of no-show, the guest remains obligated to pay 100% of the accommodation price. The cleaning fee (70.00 EUR) will be refunded in this case.
Section 6. House Rules and Usage Restrictions
- The apartment may be occupied by a maximum of 3 persons. Subletting is prohibited.
- Smoking is strictly prohibited throughout the entire apartment. Violation: 250.00 EUR cleaning fee.
- Pets are not permitted. Violation: Minimum 150.00 EUR additional cleaning costs.
- Quiet hours are from 10:00 PM to 6:00 AM. Parties and commercial use are prohibited.
- All windows and doors must be securely closed when leaving the apartment.
Section 7. WiFi Usage and Liability
- The landlord provides free WiFi. The guest is liable for all legal violations (particularly file sharing).
- The landlord assumes no liability for the availability or speed of the internet connection.
Section 8. Liability and Right of Entry
- The guest is liable for all damages caused during the rental period. Damages may be collected via debt collection if necessary.
- The landlord or authorized representatives have the right to enter the apartment in case of imminent danger or after timely notice for necessary maintenance.
Section 9. Withdrawal by the Landlord
If service provision becomes impossible due to force majeure or technical defects, the landlord will refund all amounts paid. Further claims (e.g., hotel replacement costs) are excluded.
Section 10. Choice of Law and Jurisdiction
- The laws of the Federal Republic of Germany shall apply exclusively.
- The place of jurisdiction for all disputes arising from this contract is the landlord's place of residence (Leipzig).
Section 11. Severability Clause
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
